Right to cancel

You may revoke your declaration of agreement within 14 days without providing any reason in text form (e.g., letter, fax, e-mail) or – if the item is delivered to you before the deadline – also by returning the item.

The cancellation period begins after receipt of these instructions in text form, but not before receipt of the goods by the recipient (in the case of recurring deliveries of similar goods, not before receipt of the first partial delivery) and also not before our obligations to inform under Article 246 §2 in connection with §1 paragraphs 1 and 2 EGBGB as well as our obligations under §312g paragraph 1 sentence 1 BGB in connection with Article 246 §3 EGBGB.

To meet the cancellation period, it is sufficient to send the cancellation or the goods on time.

Consequences of cancellation:

If the contract is effectively cancelled, both parties must return the received benefits, and, if applicable, any advantages gained (e.g., interest) must also be returned. If you cannot return or release the benefits or uses (e.g., use and enjoyment) fully, partially, or only in a deteriorated condition, you must compensate for the lost value.

Compensation is required only for the reduction in value resulting from handling the goods beyond what is necessary to test their characteristics and functionality. "Testing characteristics and functionality" means handling and trying the goods as would be possible in a retail shop.

Items eligible for shipping must be returned at your risk. You are responsible for the routine costs of return if the delivered goods match the order and the price of the goods does not exceed 40 Euro, or if for higher-priced items you have not yet provided the consideration or made a contractually agreed part payment. Otherwise, the return is free of charge.

Obligations to refund payments must be fulfilled within 30 days. The period begins for you with the dispatch of your statement cancelling the contract or returning the goods, and for us with its receipt.

Special note

For services, your right of cancellation expires prematurely if the contract is fully performed at your express request before you exercised your right of cancellation.

For digital content, the right of cancellation expires once the download or streaming of the digital product begins, provided that you expressly agreed to the immediate provision of the digital content and acknowledged that this would result in the loss of your right of cancellation.

There is no right of cancellation for digital content, e.g., downloading a music recording purchased from the Cocoon MP3 store.

Exclusions from cancellation

The right to cancel does not apply to distance contracts:

For delivery of goods produced according to customer specifications or clearly personalized, or that cannot be returned due to composition, perishability, or expiry date;
For delivery of sealed audio or video recordings or software if the seal has been removed by the consumer;
